    Implementation of Maryland's medical marijuana program has been a disaster. The process for obtaining medical certification needs to be streamlined to reduce delays in receiving medical certification. Maryland does not have to 'reinvent the wheel' with respect to medical marijuana. The state can look to other states with successful medical programs for guidance to improve both the licensure and certification processes.

    I support letting the voters decide, directly, the marijuana laws which they support. Maryland has over-politicized the existing medical marijuana program leading to an incredibly slow and flawed roll-out.

    I support the legalization, regulation, and taxation of marijuana in Maryland, however, I firmly believe that restorative justice and economic investment must accompany such an act. In the region, Maryland would benefit from a first mover advantage, allowing the state to tax marijuana at a higher rate, one similar to cigarettes, This higher tax rate will increase revenue generated from the sales. I propose using at least 20% of the total revenue generated from sales to reinvest in communities disproportionately impacted by the War on Drugs. Also, Maryland must expand expungable offenses to wipe clean the records of those convicted under draconian drug laws.

    Many things went wrong with the roll out. The commission should have been comprised of more people who had an understanding of the industry. There has been turnover, so that may be better at this time. People were well meaning; they just lacked the information needed for a smooth roll out. It is possible everyone was looking to the University of Maryland to take the lead; this would have created a truly medical model and given a great deal of credibility to the industry, It is also possible that UMD had to distance themselves because of accreditation concerns. Furthermore, the proprietary software is buggy, and there was insufficient training and lack of documentation. The system crashes frequently and no patients can be served until the software is functioning. The approval process was very slow, and growers were late getting started. When they did, dispensaries were left in the dark as to what strains they could expect and when they could expect them. This made it difficult for dispensaries trying to thoughtfully council patients. Finally, all business is transacted in cash because banks are afraid to run afoul of federal regulations by dealing with growers and dispensaries. This creates problems of having too much cash on site and employees being paid in cash. Reform is needed in banking, infrastructure, and approval processes.

    My preference is for decriminalization followed by a ballot referendum to show there is overwhelming support.

    For far too long, those suffering from pain, seizures and illnesses who could benefit from medical marijuana have had to wait while the State legislature, the Maryland Medical Cannabis Commission and regulatory agencies put in place policies and programs other states had successfully adopted for years.

    Additional Comments

    I support a well thought out and implemented plan for the legalization and use of marijuana that address the following issues; Too many citizens, especially in the African American and rural communities, have been seriously harmed by criminal records due to drug use. Legalization and expungement of records will remove barriers to employment and access to opportunities that have been denied due to illegal consumption of marijuana. Criminal activity associated with the sales and use of marijuana by gangs and cartels has lead to the lose of life and significant harm to individuals, families and communities. Legalization and regulation of marijuana will severely diminish the criminality of marijuana distribution. Uniform safety standards need to be in place while under the influence of marijuana to insure safe and responsible driving, operating heavy machinery and other activities that can impair judgement and capabilities after the consumption of marijuana. Additionally, more research is needed to understand the effects of marijuana use on adolescents, whose brains are still developing as well as long term use in adults on motivation, memory, acquisition of new knowledge, impulse control, depression, and the onset of dementia. Finally, all income derived from the sales of regulated marijuana shall be dedicated to public education. Such safeguards and resources need to be well thought out and securely in place to address these issues so that Maryland has a sound and sane State marijuana policy.

    Besides legalizing cannabis, I will make sure that efforts are also undertaken to review and vacate convictions for cannabis as well. The drug war has disproportionately locked up people of color and low-income Marylanders, and a review such as the one I propose would go some way towards addressing this gap.

    When I was working in the legislature, I tried to find information for my former boss. Everyone I spoke to said that the process was a year behind. When there are people suffering and not receiving timely access to medicine, that is unacceptable. I was told it was due to those seeking licensure not having paperwork in on time. While there was a wait list of others who wanted to open dispensaries, it seemed the onus was on those previously accepted by the state to submit timely paperwork. There was no backup procedure to expedite the process. Now it appears there is an influx of patient registrations, and the Commission is behind on processing those.In the future, we must be thorough with details to ensure beginning programs with the intentions of helping people is done in a timely manner and well-staffed.

    I do not think it helps our society to add marijuana as a recreational drug. Reasons: 1) if it is legalized, there will still be a black market for the higher THC potency marijuana which will not eliminate the problems we already have with selling illegal substances. 2) There is no way to test drivers who are high, making our roads unsafe. 3) We have enough trouble already with drugs that alter the mind. 4) It conflicts with federal law. 4) It will be easier for teens to obtain marijuana. 5) Marijuana has many unknown chemicals that may be harmful. 6) Marijuana smoke contains 50 percent to 70 percent more carcinogenic hydrocarbons than does tobacco smoke. If elected, I will focus on what families need to thrive. I believe that legalizing marijuana will harm families and will do nothing to help them thrive.

    The rollout of Maryland’s medical marijuana program has been mired by several problems including countless delays, controversies surrounding licensure for growers and processors, and a lack of consultation and coordination with county and local governments in regards to zoning regulations. From the beginning, the legislation should have been crafted to promote diversity and encourage minority ownership in the industry. Additionally, legislators should have provided more zoning guidance for counties and localities to ensure that dispensaries and growing and processing facilities successfully and appropriately integrate into existing communities.

    We need to pay very close attention to racial justice issues as we continue the rollout; marijuana prohibition has disparately affected communities of color, and we should use legalization to move toward making amends.

    Outside of the justice-oriented reasons for ending marijuana prohibition, the financial reasons are strong, too. A 2014 DLS report estimated $134.6 million in annual revenue from legalized, regulated, and taxed recreational cannabis. A 9% State sales tax and a $30 per ounce excise tax on growers could yield results comparable to Colorado and Washington, each of which has raised several hundred million dollars in new revenues. But we should tread softly when setting revenue targets, and we should expect the market price of licit marijuana to decline considerably from its illicit price -- by as much as 2/3. These revenues won't be a magical cure-all for our budget woes, but they'll certainly help.

    I've been disappointed by the painfully slow and troubled rollout of the state's medical marijuana program, though the silver lining is that the state can learn from its mistakes when it legalizes cannabis for adult use. I support changing the structure of the Commission to ensure that all commissioners are committed to making medical cannabis accessible to any Maryland patients who could benefit from it, and ensuring that the Commission is fully funded and staffed. I will also champion proposals to increase the number of minority-owned businesses in the industry. Finally, I support expanding protections for patients and workers. Employers should be prohibited from terminating employees based on their medical cannabis if they ability to work is not affected. Additionally, individual with prior marijuana convictions should not be precluded from working in the industry.

    Additional Comments

    I strongly support the legalization of marijuana as a way of both combatting the carceral state and raising revenue to fund other programs. A poll from 2016 showed that nearly two-thirds of Marylanders support legalizing marijuana, yet the General Assembly continues to lag behind public opinion. I will champion both home cultivation and setting a more reasonable fine for public consumption.Crucially, we must ensure that the groups oppressed by the War on Drugs are not locked out of the benefits of legalization. I’ll champion a public banking system and co-sponsor legislation that supports worked-owned cannabis businesses that hire formerly incarcerated people. Colorado’s marijuana experiment, now five years in, has generated $500 billion of revenue, and has funded school construction, substance abuse treatment programs, and efforts to combat homelessness. Now is the time to do the same in Maryland.

    There are many reasons to end marijuana prohibition and create a taxed and regulated adult cannabis market. One is as a key piece of criminal justice reform.     I support medical use marijuana and putting it to a referendum so the voters can have a say about recreational use. The problem is that while Maryland may legalize marijuana, it's still classified (wrongly, I might add) as a schedule 1 controlled substance. That will have to be changed or the 10th Amendment will have to be invoked to settle the matter in court.

    Medical Marijuana

    The speed at which medical use has moved is a result of lack of political will to change decades old thought patterns on marijuana. There are still people who believe it is a gateway drug. I don't share that belief.

    I don't smoke marijuana nor do I have any desire. But if my neighbor wants to blaze up, I have no problem with it as long as he or she doesn't get in a car and drive. I know pot is illegal but I also feel is has no more ill effect than alcohol. I'm actually of the opinion that marijuana has less negative impact on individuals that alcohol.

    It has been demonstrated that Marijuana can have a significant impact in treating some of the most difficult to treat medical conditions we are confronting today. CNN reported that a number of studies showed that treatment associated with using Marijuana in measured amounts had a significant impact in reducing and in some cases eliminating the symptoms associated with AIDS/HIV, Alzheimer's, Arthritis, Asthma, Cancer, Chronic Pain, Crohn's Disease/Ulcerative Colitis, Epilepsy, Glaucoma, Multiple Sclerosis and PTSD.We have a large number of military veterans in Maryland suffering with chronic pain and PTSD with no viable treatments available to them. With the Opioid Crisis and a belief that Opioids must be highly regulated in order to quash the high number of deaths associated with opioid (read heroin) abuse in combination with other drugs, the pain killing benefits from Opioids and Morphine are no longer available in treating many of our Vets with a need for pain management, leaving them with no viable alternative options for pain relief. This is also true with many of the other deseases and ailments listed previously that effect millions of Americans' health nationwide.The Federal Government classifies Marijuana as a Schedule 1 drug with the Drug Enforcement Agency stating that Marijuana has "no medical value". Research has shown the DEA's statement to be factually "FALSE" with no supporting factual justification coming from the DEA justifying retaining Marijuana as a Schedule 1 drug. Marijuana is basically a pawn in today's political environment. I challenge anyone to present some factually based study that shows Marijuana to be of "No medical value" and I'll show you 3 factually based studies that shows it does have medical value worth exploring and harvesting for further drug development and relief.Because of Marijuana's Schedule 1 classification, getting approval for laboratories to conduct testing to refine those parts and sub-compositions within the plant to compounds and applications that are best suited for using those compounds is arduous and most often not granted, little testing is done. The laws and approval processes allowing for further comprehensive testing of Marijuana need to change now!Legally anyone using Marijuana for medical purposesople need the benefits of this potentia, those distributing it or growing it are in violation of federal law. As such, politicians, military, law enforcement, federal civil service, first responders and others in government service are risking their careers if they are caught and prosecuted under federal law.We need to stop the political gamesmanship and get focused on the needs of the people and the pelly life enhancing if not life saving plant or we need to eliminate the obstacles to testing to be able to demonstrate why it should remain a Schedule 1 drug.

    We have had a serious issue with roll out in Anne Arundel County with the creation of overly restrictive zoning laws. We have to make medical marijuana accessible which is going to require changes to zoning as well as investment in education not only for prevention but for community support of medical facilities.

    I am still formulating my opinion on legalizing marijuana and I would prefer it not be on the ballot because it is the job of legislators to problem solve to ensure the safety as well as equity of constituents, not to ask constituents to understand every nuance and consequence of the law. We have to decriminalize marijuana use and retroactively expunge drug charges which restrict the lives and livelihoods of so many, disproportionately affecting, criminalizing, and damaging minority communities despite the ratio of use being almost equal across racial lines. I look forward to working with my fellow legislators for comprehensive policies which create access, equity, education, and prevention.

    The roll-out has been slow because the process is beholden to special interests and has limited the opportunity for other interested growers/distributors. If one doesn't have "connections", then it is difficult to become involved with the industry.

    Decriminalizing marijuana and allowing possession of a small quantity for personal or medical use would help to reduce correctional facility populations and prevent citizens from being penalized for a lifetime because they have a small quantity of pot for personal use only. I would definitely vote in favor of an appropriate bill. Depending upon bill language I would consider co-sponsoring.

    The rollout has been a disaster from a logistical and fundamental fairness aspects. The length of time it took to rollout the program is indicative of the pace of change in this state. Moreover, the licensing process was fraught with racial inequality. On this, and many other issues, new leadership is needed.

    In general, I favor taxing and regulating marijuana. The underground and criminal aspects are not necessary and are a huge waste of resources that often come at the expense of investing in other important areas where we do have significant needs (such as education and transportation to name just a couple).

    The goals of regulation in the supply chain should be to ensure quality standards, child-safe packaging and restrict access to minors. The level of bureaucratic control in MD at every step, from the limitations and rules on Doctors' through production & distribution, is excessive, divorced from a realistic assessment of risk. Excessive regulation is actually counterproductive in achieving these legitimate public health objectives if the regulated marketplace is not allowed to supplant the black market.

    I have two young children and I don't want them to become pot-heads. I also don't want them to face prison time because they made a bad decision or hung out with the wrong crowd. In 2017, there were more arrests for marijuana than all violent crime put together. This drug war is a war against US citizens. It is fundamentally unjust, disproportionately harming the poor and disadvantaged. Prohibition creates a violent black market and undermines respect for the law. The government has wasted wasted over a trillion dollars over the last four decades while accomplishing no reduction in consumption. Only in government is such a track-record of failure used to justify even more of the same.

    If a patient has trouble with their application with the MMCC Patient Registry, they are greeted with a message: "MMCC Patient Registry is experiencing very high volumes of applications for Medical Cannabis Registration. Please do not call or email the Commission unless it has been more than 45 days since submission of your initial application, or more than 30 days since you resubmitted a corrected application." To me, it seems to be an issue of misplaced priorities. Maryland must make it a priority to process these patients' applications so that they can get their certification fulfilled.

    Additional Comments

    Under the law in the majority of states, here's what can happen when an adult is suspected of possessing marijuana: men and women with guns can go into his home, kick down the door, force him to lay face down on the floor, restrain him in handcuffs, and drive them to a police station. If they are convicted of possession, a judge can order that he be locked in a cage. There are times when locking human beings in cages is morally defensible. If someone commits murder, rape, or assault, then forcibly removing them from society is a just course of action. In contrast, it is immoral to lock people in cages for possessing or ingesting a plant that the majority of Americans see as less harmful than alcohol.

    Yes- I believe that medical usage should be expanded to any health issue for which there is evidence that marijuana is significantly helpful. Not enough health issues are included in the current legislation. Tourette syndrome, for instance is not included, although other neurological disorders are. I also believe the State should do a better job educating the public that medical marijuana dispensaries and their clients do not pose a threat to public safety.

    I support the legalization of marijuana for social, legal and financial reasons. Socially, marijuana has been proven to medically benefit those with ailments such as cancer, HIV and epilepsy without having to take harass prescriptions with adverse side affects. Legally, marijuana's illegal distribution and sale has placed harsh penalties on individuals, especially men of color, causing too many men spending an unreasonable and unfair amount of time behind bars at a high cost for the state. Financially, if we legalize, regulate and tax marijuana, we take away the street market causing less supply and demand, less unnecessary arrest and jail time, and state revenue that can be designated to services and programs that need the most funding .

    I do not support this concept at this time only because we have not fully implemented the passage of HB2 that passed the Legislature in the 2018 Session. Growing cannabis at home is something that I philosophically support at the right time in the future.

    Medical Marijuana

    As the lead sponsor of the legislation in 2014 that created the Medical Marijuana program in Maryland, I absolutely agree that our program has had the slowest rollout in the nation. This past Session, I was again the lead sponsor of HB2 which legislates the diversity that should have been included in the original awarding of licenses, as spelled out in the legislation. Additionally, we included the development of the Compassionate Use Fund for patients with limited incomes to be able to access Medical Marijuana. The original Commission operated in such a manner that the public had no confidence in the way they handled the rollout of the Medical Marijuana Program in MD. There was no transparency, amid allegations of collusion, and corruption.

    Additional Comments

    We must continue to support having marijuana removed from Schedule 1 so that the Federal Government will no longer label marijuana as an illegal drug. Health Insurance companies need to be required to cover the expenses of medical marijuana for patients. The usage of marijuana is an issue that we need to continue to study, debate, and legislate in a manner that is fair and just for everyone.

    I think it is important to implement legalization and regulation well - this could be a moment to demonstrate government's ability to be inclusive, professional, and transparent. We should convene some of the leaders from around the country to discuss how various states implemented regulations and implement best practices in Maryland. We should also work with the communities that have been disproportionately impacted by the war on drugs to ensure they have a voice in this process. Finally, we should also consider dedicating the revenue to just a few areas, like health care, education, and job training.

    I think it's time we did the just, kind, and smart thing, and rolled out recreational cannabis. While what we seek is called "recreational," the truth is many people who could use it for medical purposes, don't currently seek it out because of the cumbersome application process. I can't tell you the number of friends, family members, and colleagues (many in their 50s or older, some rather conservative in their politics, many veterans) who would like to partake in cannabis use for issues like anxiety, PTSD, chronic pain, and trouble sleeping, but don't go for it because the process seems intimidating.A few years ago, Dr. Sanjay Gupta said, "It's time for a medical marijuana revolution." Ideally, one day soon the federal government will acknowledge that this is a plant with many restorative purposes and will remove it from the list of controlled substances. It is currently considered to have the same dependency as drugs like heroin, yet science does not show this to be true. Until that day, I say we take action here in Maryland and lead the charge for the rest of the country to legalization, as we have on so many other important issues. It's the right thing to do, it's the fiscally prudent thing to do, and it's time.

    Additional Comments

    I support the legalization of recreational marijuana for many reasons. First as a civil liberty issue, a criminal justice issue, and as a moral issue. The “War on Drugs” has devastated communities of color and done little to stop crime. Meanwhile, states like Colorado and Washington have been thriving and collecting millions in taxes on their upstart cannabis industries. In Maryland, we can use this tax revenue to repair the lives and communities which were disrupted - at times, destroyed - by the "War on Drugs," and then help rebuild schools and roads, as well as support the transition to clean, 21st century energy.

    There are serious issues regarding racial discrimination in the issuance of medical marijuana licenses. The General Assembly must resolve those issues next session.

    The continued criminalization of marijuana is unnecessary and a waste of law enforcement resources. Marijuana is much less harmful than alcohol or tobacco, both of which are legal. Criminalizing it needlessly stigmatizes young people with a criminal record and diverts law enforcement from addressing serious crime. And marijuans is a major source of tax revenue for education, health care and other vital government services. This vestige of Prohibition should have long since ended.

    The number one thing is to get this medicine to market as soon as possible, while also ensuring our diverse population (some of whom have been subject to draconian criminal justice laws) are able to participate in this process. One step is to expand the number of licenses offered. We saw in previous years that many minority owned businesses qualified for licenses but did not receive one of the limited licenses. However, I want to underline that I do not support any changes that delay getting this medicine to market.

    This past session I sponsored SB1039 which would have legalized marijuana in Maryland. I look forward to sponsoring this bill in future sessions. It is of critical importance to our state.

    I have several ideas for reforming the medical marijuana industry. We need to treat it like the medicine that it is by talking to patients about things like cannabinoids, different types of terpenes and CBD/THC ratios. We need to educate recommending physicians on the appropriate strains and dosages for different illnesses and ailments. I’d also like to see a consistent naming convention for strains that reflects their medical usage. Lastly, we need to address the extremely high cost of medical marijuana. Maryland has some of the highest prices in country, which is an accessibility problem.
